Polish JDG: the VAT exemption and KSeF transition use different thresholds

Track annual VAT sales separately from the PLN 10,000 monthly gross invoiced-sales transition for KSeF. Small business status alone does not answer both questions.

Polish freelancers can easily confuse two small-business arrangements: the VAT exemption and the KSeF e-invoicing transition. Their periods, purposes and consequences differ.

The general small-business VAT exemption threshold is PLN 240,000 annually in 2026. Our existing Poland guide already includes this; it is not a newly announced increase. Starting during the year requires a proportional calculation. Some activities are excluded from the general exemption, so being below the amount does not establish eligibility.

KSeF concerns issuing and circulating invoices. The February and April 2026 implementation stages have already arrived. For businesses eligible for the smallest-issuer transition, monthly gross sales documented by invoices of no more than PLN 10,000 can fall within the transitional arrangement through the end of 2026. If that monthly limit is exceeded, the obligation starts with the invoice that exceeds it. 1 January 2027 is the important next date after this transition.

“My annual sales are below PLN 240,000” therefore cannot replace a KSeF assessment. A small annual business may concentrate invoicing in one month. Track annual VAT sales and monthly gross invoiced sales separately, rather than relying on year-end bank receipts alone.

Check current eligibility and other exceptions, then KSeF access, authorisations, invoice handling and matching records. Do not leave preparation until an accountant receives a pile of PDFs at year-end.

Income-tax choice is a third issue. Progressive profit tax, the 19% flat tax and revenue-based ryczałt have different conditions; software or IT work is not universally taxed at 12% without checking the activity classification. ZUS start-up concessions also depend on eligibility, with health contributions calculated separately.

Keep annual VAT sales, monthly KSeF invoiced sales and profit records distinct. SnapLedger content can explain the recordkeeping process, but this article does not claim verified direct KSeF integration. Retention rules, full health-contribution calculations and technical exceptions require separate assessment.
